Referral program terms and conditions
Definitions
Organizer – Henryk Bartoszewicz BAX-POL, ul. Długa 9, 87-165 Cierpice, owner of the Dworek Wapionka Hotel.
Referral Program / Program – a promotional campaign through which the Referrer can receive a commission for recommending hotel services.
Referrer – a natural person (adult) who has registered for the Program via the form and has been accepted by the Organizer.
Referred / Client – a person or company that notifies the Organizer of the desire to organize an Event and indicates a specific Referrer.
Event – any group event organized at the Dworek Wapionka Hotel, e.g. conferences, training sessions, integrations, celebrations.
Commission – remuneration for the Referrer amounting to 10% of the net value of the Event, calculated according to §5.
§1. Participation in the Program
- A participant in the Program may be a natural person who is at least 18 years old and has correctly filled out the registration form.
- Participation in the Program is voluntary and free of charge.
- The Organizer may refuse to accept an application without giving a reason.
- The condition for participation is:
- consent to the processing of personal data,
- consent to the sending of commercial information and newsletter,
- acceptance of the Regulations.
- The Referrer declares that their data is true and up to date.
- The Referrer participates in the Program exclusively as a natural person. Settlements are made based on a commission contract.
- The Organizer may verify the Referrer's data at any time and refuse further participation in the Program in case of irregularities.
§2. Referral Rules
- Only one Referrer may be indicated per Event by the Client.
- The indication of the Referrer must occur no later than the Client's first contact with the Organizer – before an offer is prepared or a contract is signed.

The referral can be reported in one of two ways:
a) The Referrer registers the company/client via the Program's form
b) The Client during contact with the Organizer indicates the Referring person, who has filled in the form and exists in our database as a Referrer.
- The Referrer who registers a company via the form must provide its true contact details.
- The Organizer has the right to require the Client to confirm the indication of the Referrer.
- After the Client confirms the indication of the Referrer, it is not possible to change to another person.
- The indication of the Referrer after signing the contract, paying the deposit, or accepting the offer will not be accepted.
- The Referrer undertakes to act in accordance with the law, good practices, and not to acquire the Client's data contrary to GDPR.
- The Referrer may not transfer their rights and obligations resulting from the Program to other persons.
- The Referrer has the right to register a company through the Program's form or directly provide the company's contact details (email address) to enable the Organizer to contact it by mail. After sending the message, the Organizer will inform the Referrer about the message sent and any possible confirmation of the referral by the Client.
§3. Events Covered by the Program
- Only those Events participate in the Program that:
- take place at the Dworek Wapionka Hotel,
- have a value of at least 10,000 PLN net,
- are fully organized by the Organizer.
- Events qualifying, among others, include:
- training sessions,
- conferences,
- workshops,
- corporate meetings,
- integration trips,
- family reunions and other group events.
- The final decision to qualify the Event is made by the Organizer.
§4. The Program Does Not Include
- Reservations made through reservation portals, online platforms, brokers, and intermediaries.
- Services performed by subcontractors employed directly by the Client (e.g., DJ, bartender, photographer, event companies, technical equipment, decorators).
- Services that are not invoiced by the Organizer.
- Reservations covered by special promotions or individual discounts – if the Organizer decides they should not participate in the Program.
§5. Commission and Settlements
- The Referrer receives a commission of 10% of the net value of the Event, documented by a VAT invoice.
- The commission is charged only on services:
- fully completed,
- 100% paid by the Client,
- not subject to cancellations, discounts, complaints, or corrections.
- A commission is not due if:
- The Client cancels or reduces the scope of the Event,
- The Client does not pay the full value of the Event,
- a correction reducing the order value occurs.
- The commission is paid after:
- completion of the Event,
- full settlement of the Client with the Organizer,
- the Referrer signs the commission contract and provides data (bank account, PESEL, address).
- The commission payment is made within 30 days of signing the commission contract.
- If any doubts arise regarding the legitimacy of the referral, the Organizer may withhold payment until clarification.
- The Organizer will not pay the commission if 12 months have passed from the date of the Event's completion and the Client still has not made full payment.
§6. GDPR – Processing Personal Data
- The data controller is Henryk Bartoszewicz BAX-POL.
- Data is processed for the purpose of:
- implementing the Program (Art. 6 para. 1 lit. b GDPR),
- sending commercial information (Art. 6 para. 1 lit. a),
- tax settlements from the commission contract (Art. 6 para. 1 lit. c),
- establishing or pursuing claims (Art. 6 para. 1 lit. f).
- The Referrer has rights: access, rectification, deletion, limitation, portability, objection, and withdrawal of consent.
- Data is stored for the duration of:
- the Program,
- required by tax law,
- limitations of potential claims.
- Data may be processed by entities acting on behalf of the Organizer in accordance with GDPR.
§7. Liability and Limitations
- The Organizer may refuse to pay commissions if:
- The Referrer provided false data,
- There was abuse of the Program,
- The Referrer's actions are unlawful or violate good practices,
- Conflict arises between Referrers.
- The Organizer is not responsible for relations between the Referrer and the Client.
- The Organizer may exclude persons violating the Regulations from the Program.
- The Organizer's liability towards the Referrer is limited to the amount of the due commission at most.
§8. Complaints
- Complaints regarding the Program can be reported by email to the Organizer's address.
- Complaints must be submitted within 30 days of the problem occurrence.
- The Organizer will respond to the complaint within 30 days.
- Complaints submitted after the deadline may remain unresolved.
§9. Suspension and Termination of the Program
- The Organizer may at any time:
- amend the Regulations,
- suspend the Program,
- terminate the Program.
- The acquired rights of Referrers who met the Program conditions before changes remain preserved.
- The current Regulations are available on the Organizer's website.
§10. Final Provisions
- Matters not regulated herein are governed by the Civil Code.
- The Regulations are subject to Polish law.
- Disputes are resolved by the court competent for the Organizer's seat.
- The invalidity of one provision does not affect the validity of the others.
